General Terms and Conditions (GTC)

1. Scope of Application

These GTC apply to all orders placed through our online shop. The contractual partner is M & D Kaufwelt e.U.

2. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer. By submitting your order, you make a binding offer. The contract is concluded with our order confirmation via email.

3. Prices and Payment

All prices include the statutory value-added tax. We accept the following payment methods:
• Credit card (Visa, Mastercard)
• PayPal
• Klarna

4. Delivery and Shipping Costs

The delivery time after production (3-5 business days) is:
• Germany: 5-8 business days
• EU: 5-10 business days
Shipping is handled by our fulfillment partners.

Free shipping applies to orders with a value of 30.00 € or more. For orders under 30.00 €, shipping costs will be charged.

5. Right of Withdrawal and Withdrawal Policy

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods.

Exception: The right of withdrawal does not apply to personalized products that have been custom-made according to your specifications (in accordance with § 18 para. 1 Z 3 FAGG).

To exercise your right of withdrawal, you must inform us (M & D Kaufwelt e.U., Haushoferstraße 11, 4020 Linz, Austria, Email: info@meingeschenkwerk.de) by means of a clear statement (e.g., a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, with the following exceptions regarding shipping costs:

  • The original shipping costs will only be refunded if the remaining order value after the return is still at least 30.00 € (threshold for free shipping). If the order value falls below 30.00 € due to the return, the original shipping costs will not be refunded.
  • If the entire order is returned, the original shipping costs incurred will also not be refunded, as the condition for free shipping (minimum order value of 30.00 €) is retroactively no longer met.

The reimbursement will be made without undue delay and at the latest within 14 days from the day on which the notification of your withdrawal from this contract has been received by us. For this repayment, we will use the same means of payment that you used for the original transaction.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

6. Returns and Refunds

For non-personalized products, we accept returns within 14 days of receiving the goods.

Return shipping costs: The buyer bears the costs of returning the goods. Return shipping costs will not be reimbursed.

Shipping costs on return: If the order value falls below 30.00 € due to a partial or complete return, the original shipping costs will be deducted from the refund amount or not refunded.

In case of production defects or damaged goods, we will cover the costs and replace the product free of charge.

7. Warranty

The statutory warranty rights according to Austrian law (§ 924 ABGB) apply. The warranty period is 2 years from the handover of the goods. After 12 months, the buyer is responsible for proving that the defect already existed at the time of handover. Normal signs of wear and tear do not constitute a warranty claim.

8. Washing and Care Instructions

To ensure that the quality of our products and prints is maintained for as long as possible, we strongly recommend observing the following care instructions:

  • Washing: Inside out and at a maximum of 30 °C.
  • Dryer: Do not use.
  • Bleach & Fabric Softener: Do not use.
  • Dry Cleaning: Do not dry clean.
  • Ironing: Only at low temperature.

Products that have not been treated according to these care instructions cannot be claimed in case of damage. For defects that occur despite proper care, please contact us at info@meingeschenkwerk.de.

9. Note on AI-Generated Product Photos

Some of our product photos show AI-generated models wearing our garments. These images are solely for the purpose of depicting fit and style. For a realistic color representation, we recommend observing the product photos without a model. Color deviations due to screen settings are possible and do not constitute grounds for complaint.

10. Liability

We are not liable for damages caused by force majeure, delivery delays by the shipping service provider, or incorrect information provided by the customer.

11. Applicable Law and Jurisdiction

Austrian law applies. The place of jurisdiction is Linz, Austria.

12. Dispute Resolution
